CANCELLATION, NON-REFUNDABLE DEPOSIT & FORCE MAJEURE POLICY

1. Contractual Acceptance
By booking, paying a deposit, or engaging the services of Home Religion (“Company”, “we”, “us”), the client (“Client”) expressly acknowledges that they have read, understood, and accepted this Cancellation, Deposit and Force Majeure Policy.
This Policy forms an integral and binding part of the service agreement.
2. Non-Refundable Deposit – Binding Nature
A non-refundable deposit is required to secure any booking.
The deposit:

Is consideration for reserving time, availability, preparation, administrative work, project planning, and the loss of opportunity to accept other clients.

Is strictly non-refundable under any circumstances except where cancellation is initiated solely by Home Religion without offering rescheduling.

Shall not be considered a penalty, but a contractual allocation of risk agreed by both parties.
Payment of the deposit constitutes express acceptance of these terms.
3. Client Cancellation
3.1 Cancellation More Than 72 Hours Before Service

Deposit remains non-refundable.

Any additional payments beyond the deposit may be refunded at the Company’s discretion unless materials or preparatory work have already been initiated.
3.2 Cancellation Less Than 72 Hours Before Service
-
Deposit remains non-refundable.
-
Any additional amounts paid may be retained to compensate for lost scheduling opportunities and preparatory costs.
3.3 Same-Day Cancellation / No-Show

The full service fee may be retained.
-
No refund or rescheduling shall be granted.
4. Rescheduling
-
One rescheduling request may be granted if requested at least 72 hours prior to the appointment.

The deposit may be transferred once to a new agreed date.
-
Additional rescheduling may incur administrative fees.
-
Rescheduling is subject to availability and not guaranteed.
5. Materials & Third-Party Costs
Where services involve:

Purchase of materials
-
Custom items
-
Supplier orders
-
Transportation or logistics
-
Third-party contractor engagement
All such costs are non-refundable once incurred.
If the Client cancels after materials have been ordered or customized, the Client remains financially responsible for the full cost of those items, regardless of whether the service is completed.
6. Force Majeure & Extraordinary Circumstances
Home Religion shall not be liable for failure, delay, modification, or increased cost of performance resulting from events beyond reasonable control, including but not limited to:

War or armed conflict

Terrorism
-
Pandemics or public health emergencies
-
Government restrictions or lockdowns
-
Natural disasters
-
Acts of God
-
Supply chain disruptions
-
Energy crises
-
Economic instability
-
Inflation spikes
-
Material shortages
7. Price Adjustments Due to Extraordinary Events
In the event that any of the circumstances listed above cause:

Increases in material costs
-
Supplier price adjustments
-
Increased transportation costs
-
Increased labor costs
-
Market instability
Home Religion reserves the right to adjust the total project price accordingly.
Such price adjustments:

Do not constitute breach of contract.

Do not entitle the Client to cancellation with refund.
-
Do not require refund of any deposit or previously paid amounts.
The Client expressly acknowledges that global events may materially affect pricing conditions and agrees to bear the proportional impact of such changes.
8. EU Consumer Withdrawal Rights – Express Waiver
Where applicable under EU law, consumers may have a 14-day withdrawal right.
However, this right does not apply where:

The service is personalized or clearly customized;

Materials have been ordered or expenses incurred;
-
The Client has expressly requested commencement of services during the withdrawal period;

The service has been fully performed.
By paying the deposit and confirming the booking, the Client:

Expressly requests commencement of services where applicable;
-
Acknowledges potential loss of withdrawal rights;
-
Accepts that deposits remain non-refundable.
9. Chargebacks & Payment Disputes
Initiating a chargeback or payment dispute without contractual basis constitutes breach of agreement.
Home Religion reserves the right to:

Provide this signed/accepted policy as evidence;
-
Recover administrative, legal, and financial costs associated with improper chargebacks;
-
Suspend or terminate services immediately.
10. Limitation of Liability
Under no circumstances shall Home Religion be liable for:

Indirect damages
-
Loss of opportunity
-
Consequential loss
-
Market fluctuations
-
Material cost volatility
Liability shall in any event be limited to the amount actually paid by the Client for the specific service in dispute.
11. Governing Law
This Policy is governed by Spanish law.
Any dispute shall be submitted to the competent courts of Spain, unless mandatory consumer protection laws provide otherwise.
